Terms and Conditions for Rocket Launcher Group Pty Ltd

Effective Date: 1 January 2024

1. Definitions

In these Terms and Conditions:

  1. “Company” refers to Rocket Launcher Group Pty Ltd Trading As Rocket Launcher.
  2. “Client” refers to the individual or entity engaging the Company’s services.
  3. “Services” refers to all products and offerings by the Company, including but not limited to domains, hosting, Microsoft 365, SSL, web design, marketing, automation, and other specified services.

2. Acceptance of Terms

By engaging with our services, the Client agrees to these Terms and Conditions. This agreement is binding upon payment or commencement of services.

3. Services Offered

Domains and Hosting Services
  1. The Company resells domain names and hosting services via Synergy Wholesale (Nexigen Digital Pty Ltd trading as Synergy Wholesale, ABN: 91 137 543 018).
  2. Domain Registration and Renewal: Clients are responsible for ensuring timely domain renewals to avoid lapses.
  3. Refunds: Refunds for domain-related services will only be issued if Synergy Wholesale provides a refund.
  4. Domain Ownership: Clients own their domains upon full payment of registration or renewal fees.
  5. Hosting Services: Hosting uptime, performance, and features are provided as stipulated by Synergy Wholesale.
  6. Limitations: Hosting does not include website maintenance unless otherwise agreed.
Microsoft 365 and SSL Services
  1. Microsoft 365 licenses and SSL certificates are provided as per the terms of Synergy Wholesale.
  2. Responsibilities: The Client must ensure compliance with Microsoft’s End User Licence Agreement (EULA).
  3. Refunds: Refunds for Microsoft 365 and SSL services depend on Synergy Wholesale’s refund policy.
Website Building and Design
  1. Ownership of completed websites is transferred to the Client only upon full payment.
  2. Additional revisions or changes beyond the quoted scope will incur charges at an hourly rate.
  3. Website projects are executed in phases, and each phase will include a kick-off fee.
Marketing and Other Services

The Company offers services including:

  1. Automation
  2. Brand Development
  3. Drone, Video, and Photography
  4. Email Direct Marketing (EDM) and Newsletters
  5. Advertising (Digital and Media)
  6. Social Media Planning, Content Creation, Scheduling, and Management
  7. Search Engine Optimisation (SEO)
  8. Market Research
  9. Sales & Marketing Coaching
  10. Video Editing & Animation
  11. Podcasting Strategy & Consulting
  12. Web Design & Management

Services will be tailored to the Client’s needs and executed based on mutual agreements. Clients are responsible for providing necessary materials, access, and support to enable the Company to perform these services.

4. Payment Terms and Refunds

  1. Payments can be made via direct deposit or credit card through Stripe.
  2. Refunds will be evaluated on a case-by-case basis. Refunds will not be issued if the wholesaler does not provide a refund.
  3. Ongoing services may require direct debit arrangements via Stripe.

5. Account Suspension and Termination

  1. If payment is not received within 15 days of the due date, the service will be suspended.
  2. If payment is not received within 30 days, the service will be terminated permanently.
  3. After expiry, a late fee may be applicable for service reactivation.

6. Ongoing Management Fees

  1. Fees for ongoing services will be stipulated upfront as monthly, quarterly, or yearly payments, depending on the service.
  2. Any long-term contracts (e.g., multi-year services) will be clearly detailed in agreements.

7. Data Protection and Privacy

  1. Client data is stored locally in Perth, Western Australia, with additional measures taken to comply with Australian security and data protection laws.
  2. The Company uses Google Drive for operational purposes but ensures compliance with local data storage requirements.

8. Limitation of Liability

  1. The Company is not liable for indirect, incidental, or consequential damages arising from service use.
  2. Hosting, domain, and marketing services are provided as-is, with no guarantees of specific outcomes unless explicitly stated.
  3. The Company will not be held responsible for loss of business, revenue, or data caused by factors outside its control.

9. Intellectual Property

All designs, websites, and marketing materials created by the Company remain the property of the Company until full payment is received.

10. Dispute Resolution

  1. Clients must first contact the Company to resolve any disputes directly.
  2. If resolution cannot be reached, Clients may pursue legal or alternative methods as they see fit.

11. Amendments to Terms

The Company reserves the right to amend these Terms and Conditions at any time. Updates will be communicated via email or the Company’s website.

12. Governing Law

These Terms and Conditions are governed by the laws of Western Australia.
